No argument exists before the posture, the standard and the burden are fixed.

Every downstream judgment in motion practice changes with three answers: the procedural posture, the standard of review and the allocation of the burden. An argument drafted before they are fixed is drafted against an unknown test, and it will be checked, if at all, against whatever test the drafter happened to assume.

That is why a serious opposition system treats this ordering as a hard requirement rather than a preference. It pulls the controlling formulation of the standard from governing authority, pins it in quotation, and checks every later section against it, because standards drift by paraphrase: "plausible" slides toward "probable," and "all reasonable inferences" loses the word "all." A paragraph arguing evidence on a pleading motion is a defect, not a style choice. When the motion's own statement of the standard is a paraphrase rather than a quotation, that fact is logged as a finding.

Burden is where oppositions find their cheapest wins. Production and persuasion sit with particular parties at particular moments, and movants often write as if the opposition had to disprove the motion. Tracking what the movant had to establish before the merits open exposes the threshold issues the motion skipped. The cheapest denial is the one where the movant never earned the merits.

Burdens also move. Allocation frameworks differ across doctrines and change over time, and a change at the top, such as the end of Chevron deference, reallocates the work of persuasion across a whole field. A system that treats burden as background, rather than as an input recorded before any argument is built, will reason correctly under rules that no longer apply.
